Terms of Service

The short version

• MarketingForge and its assistant Sparky help you market your business: they write posts, plan campaigns, make images and videos, and post for you once you approve.
• AI can get things wrong. You review what goes out under your name, and you're responsible for it.
• Only use photos, logos and information you have the right to use.
• Your business information stays yours. We never sell it or use it for ads.
• Try it free for 7 days, no credit card. After that, cancel any time.

1. Your account

• You must be at least 18 and able to enter a contract.
• Give accurate information and keep your sign-in safe. You're responsible for activity in your account, including people you add to it.
• We will never ask for your social media passwords. Accounts are connected only through each platform's own secure sign-in.

2. What MarketingForge does

MarketingForge looks up public information about your business (like your Google listing, website and public reviews), learns about your business from what you tell Sparky, and uses AI to write posts, plan campaigns, design images, make short videos, draft ads and build simple pages. When you connect social accounts and approve posts, we schedule and publish them for you through our posting partner. We never post anything you haven't approved, and we never spend money on ads for you.

3. AI-written content: please review it

• Content is generated by artificial intelligence. It can contain mistakes, outdated details or wording that doesn't fit your business.
• You decide what gets approved and posted, and you're responsible for content published under your name, including prices, offers, claims and anything required by law or by the platforms (for example, rules for alcohol, firearms, health, housing, credit or jobs).
• We don't guarantee results such as followers, leads or sales.

4. Your content and permissions

• You keep ownership of your business information, photos, logos and the content made for you. You give us permission to store, process, edit (for example, crop or add text to photos) and publish it only to provide MarketingForge to you.
• Only upload or use material you have the right to use. Don't post customers' personal details or images of people without their permission.
• Reviews shown or quoted must be real reviews from your customers. Don't ask Sparky to invent reviews, testimonials or endorsements.

5. Connected accounts and other platforms

When you connect Facebook, Instagram, Google, TikTok, YouTube, LinkedIn or other platforms, you also agree to follow their terms. Those platforms can change or remove features, reject posts, or limit accounts; we're not responsible for their decisions. You can disconnect an account at any time.

Text messages from Sparky

• Program: MarketingForge Account Alerts, sent by Happy Path Solutions LLC. If you turn on texts in Your account (by entering your mobile number and checking the box), Sparky texts you about your own account: your weekly post plan, posts waiting for approval, and account alerts. You can reply YES to approve, or send photos for posts.
• Message frequency varies, usually 1 to 4 messages a week. Message and data rates may apply.
• Reply STOP to cancel at any time; we'll send one message confirming and then stop. Reply HELP for help, or email support@happypathsolutions.org.
• Carriers are not liable for delayed or undelivered messages. Agreeing to texts is not a condition of purchase.
• Our Privacy Policy explains how we handle your number: we never share it or your opt-in with anyone for marketing.

6. Free trial, billing and cancelling

• New accounts get a 7-day free trial. No credit card is needed to start.
• Paid plans renew automatically each billing period until you cancel. Prices are shown before you subscribe; payments are processed by Stripe.
• You can cancel any time from your subscription settings. You keep access until the end of the period you've paid for. Except where the law requires, payments aren't refundable for partial periods.
• If we change prices, we'll tell you before the change applies to you.

7. Acceptable use

Don't use MarketingForge to:

• break the law or any platform's rules, or promote anything illegal;
• create spam, scams, misleading claims, fake reviews or impersonation;
• harass, threaten or harm anyone, or share hateful or sexually explicit content;
• reverse-engineer, copy, overload or get around the security or limits of the service.

We may pause or close accounts that break these rules.

8. Our property

MarketingForge™, its software, design and branding belong to Happy Path Solutions LLC and are protected by law. MarketingForge™ is a trademark of Happy Path Solutions LLC. These terms don't give you rights to our brand. MarketingForge is built on the Floot platform; Floot is a trademark of its owner.

9. Privacy

How we collect and use information is explained in our Privacy Policy, which is part of these terms.

10. Changes and ending

We're improving MarketingForge all the time and may add, change or remove features. If we change these terms in a way that matters, we'll tell you in the app or by email before it applies. You can stop using MarketingForge and ask us to delete your account at any time.

11. Disclaimers and limits

MarketingForge is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, we are not liable for indirect, incidental or consequential losses, lost profits or lost data, and our total liability to you is limited to what you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

You agree to cover us for claims that come from content you approved for posting or material you provided without the right to use it.

12. Law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. If we disagree, let's first try to sort it out by email. Otherwise, it will be handled in the state or federal courts located in Pennsylvania.
